Club SOBO Terms & Conditions
These terms govern Club SOBO member use, staff use, business use, internal and external booking routes, calendar connections, legacy sales-representative access where enabled, public web routes, mobile-app features, QR scanning, loyalty, community features, business tooling, legal/email notices, website legal pages, and paid business-service workflows.
1) About Club SOBO and acceptance
- Club SOBO is operated by Spotlight Ventures Limited (trading as Club SOBO), company number 17076611.
- Registered office: 34 Grand Avenue, Southbourne, BH6 3SY, England and Wales.
- Support and legal contact: hello@clubsobo.co.uk.
- By creating an account, using Club SOBO services, submitting content, scanning or redeeming, managing a business or staff role, receiving service communications, or purchasing a paid route, you agree to these terms and the current Privacy Policy.
- If you use Club SOBO for a business, you confirm that you are authorised to bind or act for that business.
- Club SOBO member accounts are available to people aged 13 and over. Business-owner, business-admin, sales-representative, and Club SOBO platform/admin/support authority is available only to people aged 18 and over. A business may give a declared under-18 staff member ordinary staff access subject to the restrictions below.
2) Roles, accounts, and security
- Club SOBO access is role-scoped. Member, business, staff, sales-representative, and admin routes are not interchangeable.
- You must provide accurate information, keep it up to date, use the correct account type or role, and keep your password and device access secure.
- Mobile sessions may stay signed in on the same device for up to 60 days unless you log out, delete the account, or Club SOBO revokes the session earlier for security or service-integrity reasons.
- Where Club SOBO enables it, one account may hold multiple authorised capabilities, including personal member access alongside business-owner, business-admin, business-staff, sales-representative, or platform-admin tooling.
- An account must only be used by the individual authorised to use it. Shared logins, credential sharing, impersonation, and unauthorised role use are not allowed.
- New members must choose the correct age group: 13–17 or 18+. If an under-13 option is submitted, no account is created and the email address remains available for a corrected eligible signup.
- Choosing 18+ does not prove legal age or guarantee access to adult-only content. Club SOBO may use a privacy-preserving Apple or Google age-range result and may keep restricted content unavailable when confirmation is missing, declined, unavailable, expired, or unsuccessful.
- Existing member accounts created before the 13+ signup flow are not assigned an age group automatically. They receive the general experience unless current supported age evidence permits adult-only content.
- Some staff, scanner, fulfilment, QR, loyalty, admin, and business-management actions require additional checks, approved permission windows, re-authentication, or admin review before they can be used.
- Club SOBO may require password resets, sign users out, suspend capabilities, or close accounts where reasonably needed for security, fraud prevention, legal compliance, moderation, service integrity, or serious terms breaches.
3) Member use
- Member access is free.
- Members may use Club SOBO to view offers, request or manage available internal appointments, follow external booking links, use a membership code or QR, redeem eligible offers, collect and redeem loyalty benefits, interact with community and What's On features, manage preferences, and contact support.
- Members must check live offer details, expiry information, business-specific terms, booking requirements, stock limits, and redemption conditions before redeeming.
- Members aged 13–17 may use general offers, events, bookings, QR, loyalty, and community-safety features, but cannot submit or edit events. Adult-only businesses, offers, events, bookings, links, highlights, loyalty actions, QR actions, and redemptions remain unavailable without current supported adult eligibility.
- Club SOBO membership, a booking, or a QR code is not proof of age. Businesses remain responsible for any legal identity, age, licensing, safeguarding, entry, sale, or fulfilment checks.
- Offers are redeemable only while they are live, active, in date, within any configured day/time validity window, linked to an approved business, and not paused, removed, or otherwise blocked by Club SOBO controls.
- Club SOBO does not guarantee that members will make savings, receive a minimum value, or be able to redeem any particular offer, reward, booking, or benefit. Offers and rewards may vary, expire, be paused, be withdrawn, or be unavailable because of business terms, stock, capacity, opening hours, eligibility checks, app controls, or lawful operational reasons.
- Members must not fake scans, share QR access for misuse, attempt duplicate redemptions, abuse loyalty mechanics, harass other users, post unlawful content, or try to bypass security or moderation controls.
- Club SOBO may pause, refuse, correct, reverse, or investigate member activity where error, abuse, fraud, chargeback, legal risk, or service-integrity risk is suspected.
4) Staff use
- Staff use covers authorised business staff, business admins using staff or scanner tools, legacy sales representatives where enabled, and Club SOBO platform/admin/support users.
- Business staff may only use scanner, fulfilment, loyalty, and related tools for the approved business and for genuine customer transactions.
- Where temporary elevated business-staff permissions are used, those permissions apply only during the approved window, for the approved business, and for the approved operational purpose.
- Staff must not scan their own member QR, scan friends or colleagues outside a genuine transaction, issue fake stamps, alter fulfilment records dishonestly, access data without a work need, or share member or business information outside authorised workflows.
- Business admins are responsible for inviting, reviewing, suspending, and removing their own staff users where Club SOBO provides those controls.
- A business may declare that a staff member is under 18 without providing a date of birth. That person may use ordinary staff features but cannot be promoted to business admin or receive elevated access that permits offer or event publication.
- Business owners may grant selected staff separate booking-view or booking-manage permissions. Booking permission does not grant offer, profile, team, analytics, loyalty, or platform-admin authority.
- Club SOBO platform/admin/support users must use admin tools only for legitimate support, moderation, security, compliance, payment, fraud, or operational purposes.
- Legacy sales representatives may use invite-only access, referral or attribution codes, and sales-representative analytics only for authorised Club SOBO attribution, support, and historic commission reporting. They must not misrepresent Club SOBO, send unauthorised marketing, scrape member or business data, promise guaranteed earnings, or share access credentials or invite data outside authorised workflows.
- Staff activity may be logged, audited, restricted, suspended, or reviewed where needed for security, fraud prevention, dispute handling, or compliance.
5) Business use
- Business signup is free, but business access depends on approval, role checks, and ongoing compliance with these terms.
- Businesses are responsible for ensuring that profiles, addresses, map pins, logos, images, offers, Business Highlights, loyalty rules, What's On submissions, booking links, takeaway settings, and other submitted content are accurate, lawful, non-misleading, and do not infringe another person's rights.
- Businesses understand that approved business profiles, public offer details, offer images, logos, categories, descriptions, booking links, Business Highlights, and other submitted business content may be published on Club SOBO's website, including current-offer, business-directory, landing, and promotional pages, and may be crawled, indexed, cached, excerpted, or shown by search engines such as Google.
- Businesses remain responsible for their own goods, services, stock, booking availability, connected-calendar selection and accuracy, opening times, venues, health and safety, customer service, professional duties, and fulfilment.
- For every new or materially edited offer or event, the business must declare it suitable for ages 13+, adults only (18+), or not sure and requiring Club SOBO review. Alcohol-related content must be declared adult-only. Club SOBO makes an independent moderation decision and may restrict, reject, or remove content.
- Businesses offering regulated, licensed, age-restricted, professional, financial, insurance, credit, investment, health, medical, legal, tax, alcohol, or similar services must hold and maintain all required permissions, qualifications, registrations, warnings, disclosures, age checks, and customer safeguards. Club SOBO does not provide financial, credit-broking, investment, health, medical, legal, or tax advice.
- Financial, credit, insurance, investment, health, legal, and other regulated or high-risk promotions must be fair, clear, not misleading, appropriately authorised where required, and include material restrictions, risk warnings, fees, eligibility criteria, and legal information. Club SOBO may reject, hide, edit, label, or remove regulated or high-risk content where legal, safety, advertising, brand, or moderation concerns arise.
- Business admins may manage their own business profile, offers, loyalty cards, staff users, scanner permissions, Business Highlights, and business analytics where enabled.
- Club SOBO is built around genuine member value. Participating businesses must maintain offers, loyalty rewards, or other member benefits that are genuine, current, clear, lawful, and capable of being redeemed on the terms shown in the app.
- Offers, loyalty rewards, and member benefits published on Club SOBO must provide genuine value to Club SOBO members. Unless Club SOBO agrees otherwise in writing, public offer entries should be exclusive to Club SOBO members or materially better than the business's standard publicly available pricing, promotion, or loyalty offer.
- Club SOBO may set or update minimum participation standards for businesses, including requirements for live offers, loyalty rewards, staff readiness, fulfilment quality, clear offer terms, and timely resolution of redemption issues.
- If a business does not keep active, live offers or other approved member benefits available in the app for a reasonable period, or does not meet any minimum active-offer participation standard Club SOBO sets, Club SOBO may hide, suspend, or remove the business from the app, website, map, directory, search, promotional placements, and related member-facing surfaces.
- Where a business is inactive, repeatedly provides poor-value or misleading promotions, or does not provide a meaningful member benefit, Club SOBO may hide, suspend, remove, or close the business listing.
- Businesses must not submit misleading promotions, inflate activity, manipulate analytics, misuse member data, send unauthorised marketing, scrape the platform, attack third-party-cost surfaces, or use Club SOBO data for purposes outside the service without written permission.
- Club SOBO may approve, reject, edit for formatting, suspend, hide, unpublish, expire, noindex, or remove business content where moderation, legal, fraud, quality, safety, advertising, expiry, or service-integrity concerns arise.
6) Offers, QR, loyalty, rewards, and redemptions
- Offers, loyalty targets, booking limits, day/time validity windows, reward conditions, fulfilment requirements, takeaway claim rules, and redemption terms can vary by participating business.
- Businesses must make significant offer, reward, and loyalty conditions clear to members, including any expiry date, booking requirement, spend threshold, mandatory fee, service charge, deposit, delivery or collection charge, day/time restriction, stock or capacity limit, one-per-member limit, previous-price or "was price" evidence, "free" claim condition, collection or fulfilment step, age or licensing restriction, risk warning, or other eligibility rule that may affect redemption.
- QR, scan, loyalty, reward, and individual-offer redemption flows require live server-side verification and may be subject to rate limits, eligibility checks, configured offer validity-window checks, anti-replay checks, fraud checks, staff review, audit logs, and idempotency checks.
- Club SOBO may apply rate limits, target caps, outbound-service budgets, and provider-side safeguards to protect paid or quota-limited services such as email, push notifications, weather, maps, website sync, Supabase, payment, and app-store verification paths.
- Expired, not-yet-started, outside-window, draft, unpublished, takedown, wrong-business, or scan-suspended offer records must not be treated as redeemable.
- Loyalty stamps, rewards, redemptions, highlights, or entitlements may be corrected, reversed, revoked, or blocked where error, misuse, fraud, duplicate activity, chargeback, or legal risk is suspected.
- Rewards, stamps, tokens, badges, or promotional mechanics are not cash, e-money, cryptoassets, stored value, or transferable property unless Club SOBO expressly says otherwise in writing.
- Participating businesses are responsible for training staff, checking eligibility, following the app's QR, scan, loyalty, and redemption flows, and honouring valid offers and loyalty rewards they publish, subject only to the stated offer terms, genuine availability limits, lawful restrictions, and fraud or misuse concerns.
- Businesses must not impose hidden redemption conditions, refuse valid redemptions without a reasonable basis, or use attractive offers, rewards, or loyalty mechanics that they do not genuinely intend to honour.
- WeatherKit weather, map, What's On, community, booking, ordering, and external-link features are provided for general convenience only. Weather uses a fixed Southbourne location and business map pins use business-supplied or admin-adjusted location data; users should check official sources, venue/business terms, and the relevant third-party service before relying on that information for safety, travel, health, legal, booking, or purchasing decisions.
- An offer may have no booking route, a Club SOBO internal booking route, an external HTTPS booking route, or both routes as a member choice. Choosing an external link is not a Club SOBO booking, and the destination provider's terms and privacy notice apply.
- An internal request is not confirmed until the business accepts it and Club SOBO records the confirmed state. A pending calendar hold reserves the requested time while approval is outstanding but does not promise acceptance.
- Businesses must keep internal availability, resources, selected calendars, appointment duration, buffers, customer-facing rules, cancellation terms, and authorised staff permissions accurate. Businesses must review requests within the configured approval window and must not accept a request they cannot fulfil.
- A business may connect only a Google account and calendars it owns or is authorised to manage, and must disconnect access promptly if that authority ends.
- Disconnecting Google Calendar stops new internal requests and removes Club SOBO's stored connection credential. It does not by itself cancel confirmed Club SOBO appointments or delete Google events already created; those remain subject to the booking cancellation and reconciliation flows.
- Members must provide accurate booking details, attend on time, follow the stated cancellation policy, and use rescheduling and cancellation controls honestly. Repeated abuse, false requests, or no-shows may be investigated or restricted.
- Rescheduling creates a replacement request. The original confirmed appointment remains in place until the business accepts the replacement; acceptance then replaces the original appointment.
- Calendar, email, push, or device providers may be delayed or unavailable. Club SOBO does not falsely confirm a booking when the required provider hold fails, and valid booking state is not reversed merely because a notification is delayed. Users should check the latest status in the app.
- Club SOBO may send transactional request, confirmation, decline, expiry, cancellation, replacement, reminder, no-show, provider-failure, or business-risk messages to the relevant parties. These operational messages are separate from optional marketing.
- A confirmed Club SOBO appointment is not itself an offer redemption. Redemption occurs only after the existing trusted QR scan succeeds for the correct member, business, offer, resource, and permitted booking window.
- If a business is placed on activity hold, new availability, new requests, and acceptance may stop while confirmed bookings remain visible as at risk and cancellable. If a business is blocked or removed, future bookings may be cancelled, provider events removed where possible, and both parties notified. Offer unpublishing or mode changes stop new requests but do not erase confirmed appointment evidence.
- Club SOBO internal booking does not include deposits, SMS, recurring appointments, group capacity, automatic acceptance, or provider-attendee invitations unless Club SOBO expressly adds and describes those features later.
7) Content and intellectual property
- You keep ownership of content you submit, but you grant Club SOBO a non-exclusive, worldwide, royalty-free licence to host, copy, format, display, publish, moderate, promote, and distribute that content as needed to operate, secure, market, and improve Club SOBO.
- This licence includes business profiles, logos, images, offer text, loyalty rules, event submissions, community posts, comments, reports, and support submissions.
- If you connect, submit, tag, send, identify, or otherwise make your business social media content available to Club SOBO, you grant Club SOBO a non-exclusive, worldwide, royalty-free permission to use, copy, crop, format, quote, repost, adapt, publish, and promote that content for the purpose of marketing your business, your Club SOBO offers, events, listing, and Club SOBO itself.
- You confirm that you have the rights and permissions needed for Club SOBO to use that social media content, including rights in photos, videos, captions, logos, featured people, music, audio, and any third-party creator content.
- This social media permission does not require Club SOBO to use the content and does not allow either party to bypass third-party platform rules, copyright law, music or audio licensing, privacy rights, takedown requirements, or other legal restrictions.
- Club SOBO may remove, decline, or stop using social media content where there is a rights, privacy, moderation, brand, platform, operational, or legal concern.
- Club SOBO may keep social-content permission, source, rights-confirmation, publication, label, takedown, removal, and dispute records, including source URLs, handles, timestamps, reviewer notes, rights confirmations, takedown requests, and related evidence.
- Business Highlights, featured placements, promoted posts, gifted or paid content, commissioned content, affiliate-style content, or other commercially connected content may be labelled as Featured, Promoted, Ad, Sponsored, Paid partnership, or another clear equivalent where Club SOBO considers that label appropriate or legally required.
- Users and businesses must not submit fake reviews, fake testimonials, hidden endorsements, undisclosed incentives, staff or friend reviews without clear disclosure, misleading claims, or content that falsely suggests independent approval, scarcity, popularity, savings, results, or regulatory endorsement.
- Publishing business content to the Club SOBO website means it may become publicly available outside the app and may remain visible in search-engine caches, snippets, or results after Club SOBO updates, expires, noindexes, or removes it.
- You must have all rights and permissions needed for any content you submit.
- Club SOBO branding, software, interface design, platform data structures, and Club SOBO-created content remain the property of Club SOBO or its licensors.
8) Paid business services, cancellations, and refunds
- The current Highlight purchase is GBP 14.99 for one Europe/London midnight-to-midnight placement day where enabled. Offer and Event Highlights use the same purchase product and share one daily homepage slot.
- Approved business admins may Highlight their own eligible offers. An eligible adult event author may Highlight their own approved, visible and upcoming What's On event. A Highlight never transfers ownership or editing rights.
- Payment processing depends on the checkout shown at the time of purchase and may be handled by Apple, Google Play, Stripe, or another stated provider where enabled.
- Club SOBO does not store full payment card numbers.
- Payment is taken when the eligible author confirms the purchase. A placement reserves the shared day only after the verified entitlement is booked to that eligible offer or event.
- Offer Highlight changes continue to use the available Business Highlight controls. An Event Highlight is tied to that event. A future Event Highlight may be withdrawn more than 24 hours before it starts, but withdrawal does not itself create a credit, replacement entitlement, or automatic refund.
- Event edits remain subject to moderation. Reports, locks, suspension, removal, or an event ending before the day finishes may stop or shorten display. A Highlight receives an `Ad` label and priority placement but does not guarantee views, bookings, ticket sales, attendance, sales, or return on spend.
- External event booking or ticket links are operated by the organiser. Club SOBO does not sell or fulfil those tickets, and opening the link does not create a Club SOBO booking.
- Change-of-mind cancellations, withdrawals, missed change windows, or requested changes inside 24 hours of the reserved slot start do not create an automatic Club SOBO refund. Where payment was made through an app store or payment provider, any refund request may also be subject to that provider's own refund process and controls.
- If Club SOBO is unable to deliver the reserved Business Highlights placement for reasons within Club SOBO's reasonable control, Club SOBO may offer a replacement placement or refund, without limiting any rights that cannot legally be excluded.
- Refund or cancellation availability depends on the payment route used, whether review, approval, activation, display, or delivery has already begun, Club SOBO's operational controls, and any rights that cannot legally be excluded.
- Free business participation, paid Business Highlights, listing visibility, analytics, or promotional placement do not guarantee sales, footfall, bookings, redemptions, revenue, rankings, exposure, return on spend, or any particular member behaviour.
- Club SOBO may change prices or paid features prospectively with appropriate notice where required. Price terms shown at checkout apply to that purchase unless corrected for obvious error before acceptance.
9) Communications, analytics, and data use
- Club SOBO may send transactional booking, reminder, security, moderation, account-status, support, legal, payment, staff-permission, business-operation, or service-integrity messages where needed to run the service.
- Optional marketing or non-essential notification categories will follow the preferences, consent, lawful-basis, and unsubscribe routes required by law. Marketing opt-outs do not stop transactional, security, account, legal, payment, moderation, or service-integrity messages that are needed to run Club SOBO.
- Business-to-business marketing, partnership, and operational outreach to business contacts will follow applicable direct-marketing rules. Businesses and named business contacts may object, unsubscribe, or ask Club SOBO to stop non-essential outreach; Club SOBO may keep suppression, preference, and opt-out records to honour those choices.
- Club SOBO may provide businesses with aggregate analytics about their own offers and business-authored events, including views, external-link clicks, redemptions, scans, loyalty activity, and Highlights, subject to access controls and the Privacy Policy. A click is not a confirmed booking, ticket sale, attendance, or purchase.
- Club SOBO may provide legacy sales representatives with their own referral code, account status, aggregate referred-member counts, and commission or attribution figures where enabled, subject to access controls and the Privacy Policy.
- Club SOBO may use analytics to operate, secure, support, and improve the service. Aggregated or anonymised statistics may be shared in community or service-reporting contexts only where individuals are not identifiable and in line with the Privacy Policy.
10) Acceptable use and enforcement
- You must not misuse Club SOBO, attack or test security without permission, reverse engineer protected systems, scrape data, overload services, create fake accounts, impersonate others, post unlawful or harmful content, manipulate redemptions, abuse staff tools, or interfere with audit, payment, moderation, or fraud controls.
- You must not try to bypass Club SOBO rate limits, cost-control budgets, provider quotas, role checks, account protections, or abuse-prevention controls.
- Club SOBO Community Standards apply to community posts, comments, business content, What's On submissions, reports, messages, social-content submissions, and other user or business content. Content involving harassment, hate, threats, exploitation, sexual content involving minors, fraud, scams, unlawful goods or services, privacy abuse, copyright misuse, dangerous instructions, or misleading regulated claims may be removed or escalated.
- Users and businesses can report content, rights issues, privacy concerns, misleading promotions, fake reviews, or safety concerns through in-app routes where available or by emailing hello@clubsobo.co.uk. Club SOBO may preserve evidence and may provide a review or appeal route where appropriate.
- Club SOBO may remove content, restrict features, pause scanner or booking access, disable QR access, reverse benefits, cancel or mark appointments at risk, suspend staff permissions, suspend or close accounts, cancel highlights, issue warnings, contact businesses, notify authorities, or preserve records where reasonably required.
- Where Club SOBO receives reports or reasonably believes that a business has failed to honour valid offers or rewards, failed to follow the app's scan or redemption flow, ignored its own published terms, used misleading promotions, misused member data, or otherwise breached these terms, Club SOBO may investigate, request evidence, require corrections, pause offers or scanner access, remove content, suspend staff or business access, remove the business listing, preserve records, or terminate access.
- Enforcement decisions may take account of safety, legal risk, fraud risk, user impact, business impact, platform integrity, repeated behaviour, and available evidence.
11) Account deletion and ending access
- Deleting the app does not delete the account, cancel a paid business route, remove business records, or erase legal/audit records.
- Members should use the in-app account deletion flow or the published privacy choices route where account deletion is requested.
- Businesses and legacy sales representatives should contact Club SOBO or use available controls to request closure, staff removal, access changes, or content removal.
- Some records may be retained after closure where needed for legal, accounting, fraud-prevention, audit, dispute, or safety reasons.
12) Liability and statutory rights
- Nothing in these terms excludes or limits liability where exclusion would be unlawful, including liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or rights that cannot legally be excluded.
- These terms do not override mandatory consumer rights or other rights that apply to you by law.
- Subject to applicable law, Club SOBO is not responsible for participating businesses' separate goods, services, professional advice, appointment performance, venues, stock, opening hours, fulfilment, health and safety, or customer service. Club SOBO remains responsible for obligations that cannot lawfully be excluded.
- Subject to applicable law, Club SOBO is not responsible for losses arising from reliance on estimated savings, business-supplied content, third-party links, unavailable offers, withdrawn rewards, or a participating business's refusal or failure to provide goods, services, offers, rewards, bookings, or benefits.
- Subject to applicable law, Club SOBO is not liable for indirect or consequential losses, business interruption, lost profit, lost goodwill, or losses caused by misuse, unauthorised account access, third-party services, or participating-business failures.
- Club SOBO aims to keep services available, but may suspend, withdraw, or limit features for maintenance, security, legal, operational, or product reasons.
13) Changes, governing law, and related pages
- Club SOBO may update these terms for legal, security, operational, product, or compliance reasons.
- Material updates will be published with an updated effective date and, where appropriate, additional notice inside Club SOBO services, in email/service notices, or on the website. Club SOBO may require renewed acceptance before allowing further account use.
- These terms are governed by the laws of England and Wales, subject to mandatory rights and protections that apply to you.
